Portland VA Hospital Claim Attorney
Fighting for the Compensation You Deserve
Make sure veterans get the care, attention, and are treated with the utmost professionalism is key to our firm. Unfortunately, it can take quite some time to get approval and coverage for certain necessary procedures or medications. Additionally, medical negligence claims against a VA Hospital must be filed against the United States in Federal Court.
What is an FTCA Claim?
An FTCA, also known as a “Federal Tort Claims Act”, is essentially a federal statute that permits a private party to sue the federal government. Those injured by medical mistakes that occur in the VA Hospital system must first exhaust the Administrative Claims process which allows the government to evaluate any FTCA claim before a lawsuit may be filed.
Prior to beginning that process – we strongly recommend that you speak with a seasoned attorney that is familiar with both medical malpractice claims and VA laws and regulations. Military veterans and their families are entitled to pursue FTCA litigation, as are the dependents of active duty members of the military.
But active duty military members, sometimes referred to as members of the “uniformed military,” are generally not allowed to sue the government for injuries that arise during their service in the military because of what is called the Feres Doctrine. To better understand this process, we recommend contacting our firm to setup a consultation.
At Patrick Law P.C., our seasoned attorney has a wealth of experience handling medical malpractice claims, as well as fighting for veterans who have had a medical claim denied by their insurance company. As a former marine, attorney Patrick Angel knows just how vital it is for veterans of our country to get the services they deserve.
Our attorney can assist with several types of cases, such as:
